Terms of Use

These terms apply to this website and to the CompeteCue app (together, the "Service"), operated by Kourosh Sadr Momtaz ("we", "us"). By using the Service you agree to them. If the app is later distributed through the Apple App Store, Apple's standard end-user licence terms will also apply to that copy.

The Service is intended for people aged 16 or over, and by using it you confirm you are. If you are under 16, please do not use it.

1. Not medical, dietary or coaching advice

CompeteCue provides general information about preparing for fitness events. It is not medical advice, is not a medical device, and is no substitute for the judgement of a qualified clinician, dietitian or coach who knows you.

Guidance in the app is drawn from published sporting and nutrition research and is generalised — it cannot account for everything about your health, training history or circumstances. Always consult a healthcare professional before changing your diet, supplementation, hydration or training, especially if you have any medical condition, are pregnant, or take medication. If the app withholds guidance and shows a "discuss with your clinician" card, do exactly that.

2. Your responsibility

Endurance and obstacle events are strenuous and carry inherent risk. You are responsible for deciding whether you are fit to train and compete, for verifying event details (dates, start times, rules, equipment requirements) with the organiser, and for how you act on any suggestion the app makes. Event organisers' own terms and safety rules always take precedence.

3. Accuracy of information

We work to keep event data, protocols and calculations accurate and current, but we do not guarantee that any information in the Service is complete, correct or up to date. Event details in particular can change at the organiser's discretion.

4. Acceptable use

You may not misuse the Service — including attempting to disrupt it, scrape it at scale, reverse-engineer non-public components, or use it for unlawful purposes.

5. Intellectual property

The CompeteCue name, logo, design and content are owned by Kourosh Sadr Momtaz. The source code is available for viewing under a restricted licence — see the licence. No other rights are granted.

6. Disclaimer and liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, we exclude liability for any indirect or consequential loss, and for any loss or injury arising from reliance on information in the Service. Where we are liable to you despite the above, our total liability is limited to the greater of £100 or the amount you have paid us for the Service in the twelve months before the claim. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law — including, for UK consumers, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your statutory consumer rights.

7. Changes and termination

We may update the Service and these terms; material changes will be dated on this page. We may suspend or discontinue the Service (or any feature) at any time. Because your data lives on your device, discontinuation of our servers does not delete your information.

8. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer, you keep the benefit of any mandatory protections and forum rights of the country you live in.

9. Entire agreement and severability

These terms, together with the privacy policy and the licence, are the whole agreement between us about the Service. If any part of them is found to be unenforceable, that part is severed and the rest continues to apply. A delay in enforcing a term is not a waiver of it, and you may not transfer your rights under these terms to someone else.
